EDMONTON – The man arrested and charged in connection to a fatal hit and run back in June, 2016 that killed an Indo-Canadian senior, was sentenced  to five years in hail in an Edmonton courtroom Monday.

Back on Monday, June 20, 2016, a 73-year-old male pedestrian Ajaib Grewal was hit at Mill Woods Road South at 48 Street at about 4 p.m.

The vehicle, a Jeep Wrangler, stopped briefly, before the driver fled.

Later on, Erick Garcia was found inside the vehicle a short distance away in the area of 36 Street and 12A Avenue – police said the 38-year-old smelled of alcohol, had slurred speech and could barely stand, reported CTV Edmonton.

Court documents showed Garcia drove through a four way stop and hit the pedestrian, later identified as Ajaib Grewal, 73. The impact of the crash sent Grewal into the air, before he landed face-down on the road. He was pronounced dead at the scene.

An open Mickey of alcohol was found under Garcia’s seat in his vehicle, and his blood alcohol level was found to be more than double the legal limit – in addition, he had no memory of the collision.

Garcia faced four charges, including criminal hit and run causing death.

During sentencing, the judge said: “These are facts that should make everyone angry”. She accepted a joint submission from the Crown and defense, and sentenced Garcia to five years in prison, less time served. He will spend a total of four years, ninety days behind bars.

After his sentence, Garcia will face a five year driving ban.
