SUVA – Disbarred lawyer Dr Samshud Dean Sahu Khan used money from trust accounts belonging to his clients said the Independent Legal Services Commission.

Commissioner John Connors ordered the Chief Registrar to notify the Auckland Law Society, the New Zealand Law Society and the Attorney-General of New Zealand of this. The orders were made last week.

He said Dr Sahu Khan had told the ILSC through his lawyer, Natasha Khan, he had no intention to return to Fiji to answer disciplinary proceedings against him.

When Dr Sahu Khan was disbarred in May this year, he was ordered to pay $120,000 to the complainant and then his passport would be given back to him.

The fine was imposed after he was found guilty of professional misconduct in May 2010. He paid the ILSC with clients’ money, took the passport and then travelled out of Fiji.

Commissioner Connors also ordered that Dr Sahu Khan not be issued with a practising certificate. He was ordered to surrender his passport to the ILSC within 24 hours upon his return to Fiji.

He said since Dr Sahu Khan was not returning, notice should be given to his lawyer Natasha Khan and this would be deemed as notice to Dr Sahu Khan.
